If Supplier determines it no longer will be able to ship or deliver Materials by the agreed shipment date or delivery date, Supplier will notify Avaya (or the SP where applicable) immediately in writing. If Avaya (or the SP if applicable) elects to extend a delivery date; then for those extended deliveries where delays were caused by Supplier, Supplier will be solely responsible for the difference between charges to ship normal transportation and charges to ship premium or expedited from Supplier to the SP and, if required to fulfill Avaya customer orders, from the SP to end customers.
