【Abstract】：With the increasing international economic exchanges and China's accession to the WTO, it has become an irresistible trend to fully implement the principle of National Treatment. However, the current situation in this respect in China is not optimistic, especially in terms of foreign investment. Therefore, urgent measures should be taken to improve it. This paper discusses and analyzes the current implementation of the principle of National Treatment in China, in the field of foreign investment in particular. By comparing and enumerating, it gives a definition of the principle of National Treatment and points out that there are two major problems with implementation of this principle in the field of foreign investment, i.e. cognition and legislation, which face a major barrier that the market economic system in China is far from being perfect. Furthermore, it also gives some solutions to those problems, including how to improve cognition and legislation, and how to consummate the market economic system by taking short-term measures.

By defining the principles of national treatment, and analyzing its present status of implementation particularly in the foreign investment sector, this paper suggests that the problems of its implementation are mainly in the aspects of ideological understanding and legislation, as well as the obstacle of faultiness in the market-based economy system; and in order to solve this problem, this paper proposes a three prone measure to improve the market-based economy system by rectifying the ideological understanding, improving the legislation and adopting a short-term complementary approach.
