结合国内劳动争议裁审模式各家观点和国外劳动争议裁审模式,参考我国国情和劳资关系现有状况,笔者认为应当建立“争议分流、或裁或审”的模式。充分合理进行资源配置,科学分流劳动争议案件,最大限度的发挥调解、仲裁和诉讼各自的特点和功能。
